Still on Hudud and Syariah.......





Salam,

I attach herewith, a news report of a Saudi woman who was gang raped in 2007 and who was punished by the Saudi courts while some of her attackers got away. This is an illustration of the implementation of Hudud laws by a Judiciary who have a low opinion of women and who refuse to recognize that women too have rights and are entitled to justice under the law. This is not the Islam that we are familiar which is a religion of justice and equality and compassion . 
With regard to Pas' Hudud bill , I will also forward to you a scholarly article by Prof Hashim Kamali of the UIA which analyses the bill in detail from the perspective of the Quran and the Hadith. Unlike some of us, he does not quote the Quran out of context . We need to have an intelligent debate on this issue and not blindly support this bill which Pas obviously is trying to sell to our Muslim community to further their political agenda. 
A poster caught my eye with the following message :
' The biggest enemy of Islam is the ignorant Muslim, whose ignorance leads him to intolerance, whose actions destroy the image of Islam, and when they look at him, they think that Islam is what he is' .

As a Muslim , all these cases notwithstanding, I will always be careful about what I would discuss with the lay public, especially the 'secular gallery' like most of our press, on things hudud and things Islam, especially if my own knowledge in it is still very much wanting.

Prof Kamali may say his piece and he is entitled to that.  I have read his views on Islamic banking and i am not impressed.

The gold standard as fellow muslim is required, when we read views which are in contradistinction to the qur'anic verses and the hadiths , is to ask oneself the following questions regarding the bearer of the opinion: not just the scholarship of the writer or the ulama' or whoever he or she is. it is the sincerity and the depth of knowledge and wisdom; " dah cukup kah sembahyang depa? dah cukup kah istiqamah depa;  are they sincere muslims? are they real scholars of the 'ugama' or just phd's ; are they perfect experiential Muslims; are they playing to the gallery? is this 'cari makan'? ". Only if you are happy they qualify all these high attributes, then recheck with other scholars. Othererwise throw them out....

I am afraid with Sisters in  Islam,[ and I am not even sure of even Prof Kamali  ], I cannot with all sincerity come to a solid conclusion that I can swallow whatever they put forward on the public front.
That is a personal conclusion and many others share the same feeling. 
We may not have the arena of the papers and the gallery but that is a valid feeling from most of us.
Whether we are the silent majority I do not know, 

But you guys , in the stillness of the night , in your own time, should sometime ask these question yourselves and be sincere about it.
Even Imam Ghazali asked similar question some 1000 years ago which lead him to go on a 12 year khalwah to redefine himself and came out a better scholar.
You guys have to be sincere with yourselves
Leave the public accolades and the 'cari makan' aside.
In your 50's and your 60's, there are more important issues for you guys to think about.

Nik Howk, I'm afraid I must agree with dato noor Faridah here. I don't know if I dah cukup sembahyang or not but only Allah knows and that is more important. And I don't really care what other people think.

as i say, if in the stillness of the night you feel you are right doing what you are doing, putting hudud and things islam on the public gallery, go ahead
i feel it is not the place and forum to discuss islam
it is not the place and forum to hit at scholars
islam is not for sale
islam is not about putting things to a vote
it is not about accolades
it is certainly not 'cari makan'

On the subject of Hudud, I don't need to 'cari makan'. Many of us are sincerely and genuinely concerned about the imposition of Hudud in a multi religious society. Sisters in Islam and Prof Hashim Kamali have been sincere in their views of the Pas' Hudud bill and have raised genuine concerns about some provisions of the bill. For your elucidation, I have forwarded to you Hashim Kamali's scholarly critique of the Hudud bill. Please comment on this article rather than what he has to say on Islamic banking. 
At the end of the day, Allah will judge us and not Pas or even yourself. On spiritual matters , I am guided by my Sheikh who is knowledgeable about Islam and who has been accredited by JAIS. Even my Sheikh who is from Medina but he is not a Wahhabi, is not in favour of the implementation of Hudud in Malaysia. He thinks there is nothing wrong with the present secular laws in Malaysia  as they don't prevent Muslims from practising their faith or tread on their rights. His concern about Hudud being imposed on multi religious Malaysia is that it might drive Muslim offenders to apostasy when they are given severe punishment for offences such as chopping off the hand for theft and a non Muslim offender gets away with a light prison sentence. My Sheikh's concern is shared by another well known Sheikh of the Tariqat Shazaliyyah , Shaykh Mohamad Yacoubi, who is of the same view. 
At the end of the day, everyone is entitled to their own views. Please don't stoop so low as to accuse others who don't share your views of trying to 'cari makan'. It 's a cheap tactic to bring down others and not very Islamic is it?
For your information, I do not wish to engage further in this discourse with you . Let us agree to disagree . As I said before, let Allah be our judge on this issue.

Yes, let us agree to disagree
The argumentation is never going to end
We are looking at the same object through different prisms
I could perhaps wake up ,as i did just now , on the 'right' side of my bed and say,'no to hudud and the syariah' and write beautiful and plausible writing against it
God forbids, I dont. Alhamdullillah.
Brilliant legal mind like yours, could likewise wake up one day, and as clear as there will be a tomorrow after today, insyallah, and say 'yes to hudud and the syariah', and that would be wonderful' for Islam.

to HIM it is as simple as that.
If He chooses to not constrict one's chest, it will be more open to accept His laws and dictates without inertia.
...and anyway,Islam can do with one or two more brilliant minds working for it than against it

Yes, let us agree to disagree.
HE will judge all of us in " Yaumiddin"
